Felonies

A felony is the most serious type of charge a person can face, and having the right representation is crucial. Moorhead & Griffin, LLP, have represented clients charged with felonies some of which include, but are not limited to: robbery, grand theft, drug possession and/or sales, sexual assault, burglary, aggravated assault and murder. Penalties for felonies range from one year to life in prison to the death penalty. In Colorado, felonies are divided into six different classifications, depending upon the nature of the crime.

Felony
Class 1
Class 2
Class 3
Class 4
Class 5
Class 6

Minimum Sentence
Life imprisonment
8 years/$5,000 fine
4 years/$3,000 fine
2 years/$2,000 fine
1 year/$1,000 fine
1 year/$1,000 fine

Maximum Sentence
Death
24 years/$1 million fine
12 years/$750,000 fine
6 years/$500,000 fine
3 years/$100,000 fine
18 months/$100,000 fine

Each of the six different felony classifications contains a presumptive penalty range, which provides for a minimum and maximum level of incarceration to be levied against a defendant, if incarceration is imposed. The court may deviate from the presumptive penalty range if extraordinary aggravating or mitigating circumstances are found. It is important for a client to understand the process. On a first offense, it's preferable for a person to be represented, but we understand that it's not always possible. I like to at least make certain that people go into the situation with their eyes wide open. If I can give them some advice about what to watch out for, I will feel better about their decision to be unrepresented.
